The Regulation of Investigatory Powers Act 2000 (RIPA) requires people engaged in RIPA activity to consider five key terms including Necessary, Proportionality and Collateral Intrusion.
However, there is clearly confusion surrounding these terms and this lack of knowledge and understanding remains a constant criticism of the Office of Surveillance Commissioners (OSC).
Not only is this lack of understanding regularly reported upon by the Office of Surveillance Commissioners when they conduct their inspections but it is also exploited by defence barristers in legal proceedings, resulting in the understanding and application of anyone involved in this process being regularly examined in courts across the UK.
